GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Commonwealth of Virginia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Arlington County, Virginia, or the applicable federal courts. DC Mobile Notary operates in Virginia (primary), Washington, DC, and Maryland, and services performed in those jurisdictions are subject to the applicable laws of each respective jurisdiction where services are rendered.

LIMITATION OF LIABILITY AND ACKNOWLEDGEMENT OF RISK

By engaging DC Mobile Notary, you acknowledge and accept the following:

  1. No Guarantee of Results: While we strive to provide high-quality and timely services, we do not guarantee specific outcomes, such as acceptance of documents by third parties, processing times, or other results beyond our control.
  2. Loss or Damage in Transit: Documents may be lost, delayed, or damaged during transit (including mail, courier, or electronic transmission). DC Mobile Notary is not liable for such losses or delays.
  3. Human Errors and Mistakes: Errors, including but not limited to typographical mistakes, incorrect notarization, or omissions, can occur despite our best efforts. DC Mobile Notary's liability is strictly limited to providing a full refund of service fees paid. No further claims, damages, or liabilities will be considered.
  4. Use of Independent Contractors: DC Mobile Notary may use independent contractors or third-party agents to perform services such as notary, apostille, I-9 employment verification, and translation services. While we ensure contractors meet professional standards, we do not assume responsibility for their actions, errors, omissions, or the quality of their work. Any disputes or claims related to the performance of these contractors must be addressed directly with the contractor.

TRANSLATION SERVICES DISCLAIMER

For certified and certified notarized translation services:

  • DC Mobile Notary contracts third-party translation professionals to perform these services.
  • We are not responsible for the accuracy, quality, or completeness of translations performed by third-party contractors.
  • In case of errors or disputes, clients are advised to communicate directly with the translator.
  • Our liability for translation services is strictly limited to a refund of service fees paid for the translation, if applicable.

CANCELLATION AND NO-SHOW POLICY

We understand that schedules change. To respect the time of our notaries and other clients, the following cancellation policy applies:

  • Free cancellation: Cancellations made more than 2 hours before the scheduled appointment are free of charge.
  • Late cancellation fee: Cancellations made less than 2 hours before the scheduled appointment time will be charged a $95 cancellation fee.
  • No-shows: Clients who do not appear at the scheduled time and location without prior notice will be charged a $95 no-show fee.
  • How to cancel: Contact us by phone, email, or text at least 2 hours before your appointment to avoid any charges.

This fee reflects the travel time and operational costs incurred by our mobile notaries. By booking an appointment, you acknowledge and accept this policy.

PAYMENT TERMS AND AUTHORIZATION

By booking or engaging services with DC Mobile Notary, you authorize Express Apostille LLC (DBA DC Mobile Notary) to charge the payment method provided at the time of booking for:

  • The agreed-upon service fee for the services requested.
  • Any applicable cancellation or no-show fees as described above.
  • Any additional service fees that arise from changes to the scope of services, agreed upon in advance.

All payments are processed securely through Square. By providing your payment information, you confirm that you are authorized to use the payment method provided and that the information is accurate. DC Mobile Notary does not store full card information on its servers.

Chargebacks and Disputes: Before initiating a chargeback with your bank or credit card provider, clients agree to contact DC Mobile Notary at support@dcmobilenotary.com to attempt resolution. Chargebacks initiated without prior good-faith communication may be disputed by DC Mobile Notary and may result in collection of the full outstanding balance plus associated fees.

REFUND POLICY

If an issue arises due to a service-related error by DC Mobile Notary, we will provide a full refund of the service fees paid. This refund constitutes the full extent of our liability. No additional compensation, claims, or damages will be provided.

SERVICE-SPECIFIC TERMS

  1. Mobile Notary Services: We provide mobile notary services to clients in Washington, DC, Virginia, and Maryland. Clients are responsible for ensuring all required documentation is complete and accurate before appointments. DC Mobile Notary is not liable for delays, rejections, or issues caused by incomplete or incorrect documentation.
  2. I-9 Employment Verification Services: Our role is limited to assisting with the completion of Form I-9. Employers retain full responsibility for compliance and accuracy.
  3. Apostille Services: Apostille services are provided based on information and documentation submitted by clients. DC Mobile Notary is not responsible for delays, rejections, or errors caused by incomplete submissions or actions by third parties (e.g., state or federal agencies). Processing timelines are estimates and are not guaranteed.
  4. FBI Apostille Services: FBI background check apostille services involve multiple government agencies and processing steps outside our control. Timelines are estimates only. DC Mobile Notary is not liable for delays caused by the FBI, the U.S. Department of State, or any other agency.
  5. Embassy/Consulate Legalization Services: Embassy or consulate legalization services are subject to the policies, timelines, and procedures of the respective embassies or consulates. DC Mobile Notary is not liable for delays, denials, or policy changes beyond our control.

Fingerprinting Services (FBI, FDLE, ATF, FD-258 Cards & Live Scan)

DC Mobile Notary provides fingerprinting services for multiple purposes and agencies, including FBI background checks (via Live Scan and FD-258 ink cards), Florida Department of Law Enforcement (FDLE), Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and other authorized agencies. The following terms apply to all fingerprinting services:

  • Valid ID required: A government-issued photo ID is required at the time of the fingerprinting appointment without exception. DC Mobile Notary cannot perform fingerprinting services without proper identification, and no refund will be issued for appointments where the client fails to present valid ID.
  • Print quality: DC Mobile Notary takes all reasonable care during the fingerprinting process. However, we are not responsible for fingerprint rejections by any receiving agency (FBI, FDLE, ATF, or others) due to poor print quality, skin conditions, worn ridges, or other factors outside our control. A resubmission fee may apply for repeat appointments.
  • FD-258 Ink Cards: Completed FD-258 fingerprint cards are provided to the client or submitted as directed. DC Mobile Notary is not responsible for cards lost, damaged, or rejected in transit or upon receipt by the requesting agency.
  • Live Scan submissions: Electronic Live Scan fingerprints are transmitted directly to the designated agency. DC Mobile Notary is not responsible for transmission errors, agency system outages, or processing delays that occur after successful submission on our end.
  • Non-refundable once submitted: Once fingerprints have been taken and/or submitted to any agency on the client's behalf, all service fees are non-refundable. Government processing fees paid on behalf of clients are non-recoverable under any circumstances.
  • Processing timelines: All processing timelines are set by the receiving agency (FBI, FDLE, ATF, or other) and are entirely outside DC Mobile Notary's control. We do not guarantee processing times and are not liable for delays.
  • Agency requirements: Each agency has its own form requirements, submission formats, and acceptance criteria. It is the client's responsibility to confirm the correct fingerprint format required by the requesting agency or employer before booking. DC Mobile Notary is not liable for rejections resulting from the client submitting fingerprints in an incorrect format or to the wrong agency.

WAIVER OF LEGAL CLAIMS

BY USING OUR SERVICES AND ACKNOWLEDGING THESE TERMS, CLIENTS EXPRESSLY WAIVE ANY RIGHT TO SUE DC MOBILE NOTARY, EXPRESS APOSTILLE LLC, THEIR EMPLOYEES, CONTRACTORS, OR AFFILIATES FOR ANY CLAIMS RELATED TO THE SERVICES PROVIDED, BEYOND THE REMEDY OF A SERVICE FEE REFUND AS DESCRIBED HEREIN.

Any disputes not resolved through direct communication with DC Mobile Notary will first be submitted to mediation before any legal action may be taken. The mediator shall be mutually agreed upon by both parties. If mediation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association in Arlington, Virginia.

ACKNOWLEDGEMENT OF TERMS

By submitting any form, booking any appointment, or engaging services with DC Mobile Notary, clients confirm they have read, understood, and agree to these Terms and Conditions in their entirety. For certain services, clients must also confirm their acknowledgment by checking the agreement checkbox on the applicable form before submission.

The Site may feature testimonials that reflect the experiences and opinions of clients. Testimonials are personal to those individuals and may not represent your experience. YOUR INDIVIDUAL RESULTS MAY VARY.

SMS POLICY

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
